By accessing or purchasing from Cartain, you agree to be bound by these Terms of Service. We may update or modify these Terms from time to time to reflect changes in our business or legal obligations. Changes will take effect upon posting to this page. Where changes are significant, we will take reasonable steps to notify customers. It is your responsibility to review these Terms periodically.
SECTION 2 - AUSTRALIAN CONSUMER LAW (ACL)
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. These Terms apply in addition to, and do not limit, your rights under the Australian Consumer Law.
SECTION 3 - PRICING, GST & ORDERS

  • GST: All prices are in Australian Dollars (AUD) and are inclusive of GST.
  • Errors: We reserve the right to correct pricing errors. In the event of a "manifest error" (an obvious technical glitch), we may cancel the order and provide a full refund.
  • Order Refusal: We reserve the right to refuse service or cancel orders at our discretion, including where we suspect fraudulent, unauthorized, or unlawful activity.

SECTION 4 - ROAD LEGALITY & COMPLIANCE

  • Local Laws: Car accessory regulations vary between Australian States and Territories. It is the customer’s responsibility to ensure that products are used in compliance with local road safety standards.
  • Liability: To the extent permitted by law, we are not liable for fines or penalties arising from the use of products in a manner that does not comply with Australian laws and regulations (including Commonwealth and State laws).

SECTION 5 - SHIPPING, TITLE & RETURNS

  • Responsibility: In accordance with the ACL, we remain responsible for the goods until they are delivered to you. Title to the goods passes to you upon delivery.
  • Policy Integration: Our Returns & Refund Policy and Shipping Policy form part of these Terms of Service.
  • Address Accuracy: If an order is returned due to incorrect delivery details provided by the customer, redelivery fees may apply.

SECTION 6 - LIMITATION OF LIABILITY

  • General Liability: To the extent permitted by law, Cartain is not liable for any indirect, incidental, or consequential loss (including loss of profit or damage resulting from misuse or incorrect installation) arising from the use of, or inability to use, our products or website.
  • Website Availability: We do not guarantee that the website will be uninterrupted, timely, or error-free.
  • Installation: We recommend professional installation for all technical accessories. We are not liable for damage caused by incorrect installation or misuse, subject to your rights under the ACL.

SECTION 7 - ENTIRE AGREEMENT
These Terms, along with our Privacy Policy and Shipping/Refund Policies, constitute the entire agreement between you and us regarding the use of our website and services.
SECTION 8 - GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes shall be subject to the non-exclusive jurisdiction of the courts of Victoria.
